Federal Nonbankruptcy Exemptions


In Iowa, a bankruptcy filer must claim state property exemptions when claiming exempted property.  Additionally, the filer is entitled to the following exemptions (only when claiming state property exemptions).  If the filer is in another state and claiming federal bankruptcy exemptions, the filer is NOT entitled to the following.

Savings account deposits while on permanent military duty outside the USA, unlimited amount. 10 U.S.C. 1035.

Seamen's clothing (unlimited amount). 46 U.S.C. 1110

75% of earned but unpaid wages. 15 U.S.C. 1673.

Wages of seamen while on a voyage (unlimited amount). 46 U.S.C. 11111.

Social security (unlimited amount).  42 U.S.C. 407

Veteran's benefits (unlimited amount). 38 U.S.C. 3101.

Veteran's Medal of Honor benefits  (unlimited amount).  38 U.S.C. 1562.

Military honor roll pensions (unlimited amount)  38 U.S.C. 562.

Military service employees pensions (unlimited amount). 10 U.S.C. 1440.

Civil service employees pension (unlimited amount).  5 U.S.C. 8346.

Foreign service pension (unlimited amount) 22 U.S.C. 4060.

Railroad workers unemployment insurance (unlimited amount) 45 U.S.C. 352(e).

Military service survivor benefits (unlimited amount). 10 U.S.C. 1450.

Judges survivor benefits (unlimited amount) 28 U.S.C. 376.

Government employee death and disability benefits (unlimited amount) 5 U.S.C. 8130.

U.S. court director's survivor benefits (unlimited amount) 28 U.S.C. 376.

War hazard death or injury compensation (unlimited amount) 42 U.S.C. 1717.

Military service survivor benefits (unlimited amount) 10 U.S.C. 1450.

Judicial center director's survivor benefits (unlimited amount). 33 U.S.C. 775.

Supreme Court Chief Justice Administrator's survivor benefits (unlimited amount) 28 U.S.C. 376.

Lighthouse workers survivor benefits (unlimited benefits) 33 U.S.C. 775.

Longshoremen death and disability benefits (unlimited benefits) 33 U.S.C. 916.

Klamath Indian tribe benefits (unlimited amount) 25 U.S.C. 543, 545.
