Procedural Due Process in Municipal Commissions [2009-11-14]
In
Botosko v. Davenport Civil Rights Commission , the Iowa Supreme Court decided that attorneys’ fees are not recoverable in the absence of a statute or contract provision, regardless of policy objectives; local civil rights commissions closed deliberations do not violate procedural due process; and that an advocate cannot then retreat into closed session to answer questions without violating due process in administrative proceedings.
