If a person has been charged with a drug or alcohol related offense, such as OWI, the defendant must obtain a substance abuse evaluation before his/her next hearing. Failure to obtain the evaluation may lead to jailing until the evaluation can be obtained. Prior to sentencing, an evaluation must be available to the judge.
